Physical custody is how the parents allocate time with their children, essentially. Although nowadays physical custody is really a relic in the law, and what we pay attention to in family law is parenting time, and allocating the parenting time between the parents in the best interest of the children. Now, with parenting plans, the parties to a divorce or a custody case don’t even necessarily need a physical custody label.
