I help clients first determine what are the issues in the divorce. Often times, what comes into play in international divorces is custody of children, and where children are primarily going to reside, and how they’re going to have time with the other parent. That’s one issue.
A second issue can be property. If parties have property in different jurisdictions, how does that get handled? Minnesota can handle allocating property. Even if it’s in a different country, the value of the property can be taken into consideration and allocated between the couple.
A final issue that may need to be addressed is support. Who is paying support? How can support be enforced across international lines?
